I installed this on my wife's computer who is still running Windows XP and it worked without any modification to the uxtheme.dll, which a hacked version is typically needed for any themes that are not created by Microsoft.I would say that this is safe and I'm sure Microsoft would deny any knowledge of a theme that hasn't been released, especially since there are a few things that were left unfinished.
