OEM just means its going to be cheaper, not in a proper box and wont be supported by the company that made it.

At the end of the day whatever the licence people are still going to use it wherever they can. M$ have far too much trouble with piracy on a large scale to ever chase someone using the same copy on a new PC they've built.

Good question. One question that I have is; Do online retailer require you to buy a piece of hardware to get the OEM copy? I have never bought OEM software online before. Back quite a few years ago when computer shows were the rage, you could buy OEM software without buying any hardware.

People apparently think that you can transfer Windows XP to as many computers as you would like but Paul is quick to point out that Windows is tied to a device and not a person.

So, what is a device? Is it a whole PC, or will a motherboard, CPU or hard drive do? For a while you had to buy a piece of hardware in order to leagally buy an OEM copy of windows XP. I know most online retailers would sell you the OEM copy even if you just bought a mouse or something.
